- Abstract
The concept of Allocation of Certain Risk specifically has been regulated in the Convention on International Liability for Damage Caused by Space Objects 1972 (hereinafter referred to the Liability Convention 1972). However, practically such allocation is very hard to be implemented. This study aims to elaborate the mechanisms of the allocation of certain risk as the Liability Convention 1972 submit it to the internal agreement between the parties of such outer space activities. This study used normative juridical method which analyze the existing legal framework in outer space activities. Some countries are actively conducting outer space activities have applied the concept of Allocation of Certain Risk in describing the allocation of the division of liabilities between the parties to a joint launching. Therefore, the study of the concept of Allocation of Certain Risk and its practical application in several countries become indispensable for the creation of a national legislation on liability in outer space activities.
