Abstract

Land utilization has evolved by utilizing underground space through three-dimensional buildings. This situation causes land rights to be different on surface land and underground space. This difference in users often leads to conflicts between holders of rights to surface land and underground space. This paper discusses whether the holders of surface land rights get protection from the applicable law in Indonesia for the use of underground space just below the surface space? The research method used in this study is normative legal legal research by examining the rules regarding the protection of land rights holders in the utilization of underground space. The research findings show that land rights holders are protected by law in Indonesia. If the use and management of underground space has the potential to interfere with the public interest and the interests of land rights on the surface of the land, then a legally binding agreement must be made through an official deed. The amount of the loss must be computed in money or other terms in line with the terms of the contract signed with the party that used the underground space, as determined by the land appraiser.
