- Abstract
The development of law in Indonesia, one of the efforts to carry out a reform of national law is the preparation of the Criminal Code which has been passed into Law of the Republic of Indonesia Number 1 of 2023 concerning the Criminal Code. The drafting of this law aims to replace the Criminal Code which originated from the colonial period, namely Wetboek Van Strafrect, which has been regulated in Law Number I of 1946 concerning Criminal Law Provisions which has undergone several amendments. This Amendment Act is an effort in the context of efforts to develop national law. This effort is one of the legal developments for the Indonesian government. This law needs legal renewal, bearing in mind that there are changes and developments in society, the law must also follow the development of that society. In the Law of the Republic of Indonesia Number 1 of 2023 concerning the Criminal Code there is an amendment or addition, one example is the regulation regarding legal subjects in the realm of criminal law where as there are two legal subjects namely crimes against individuals (Naturlijkpersoon) and crimes against corporations (Rechtsperson). The focus of this research will involve examining how corporate criminal offenders can be held accountable. The research method to be applied is a normative juridical approach using the Statute Approach and the Conceptual Approach. This is one of the aims of the author to discuss the formulation of the problem regarding how corporate criminal acts are held accountable as stipulated in the laws and regulations of the Republic of Indonesia number 1 of 2023 concerning the Criminal Code. As for the results of the study, it was concluded that responsibility for criminal acts by corporations has been accommodated as a subject of criminal law so that if the corporation is involved in a criminal act, its responsibility can be requested.
