- Abstract
In recent years, due to the booming Internet economy, the O2O model has emerged. Under this model, the working form of laborers is flexible, and the employment methods of employers are diverse, which leads to the more complicated identification of labor relations. In practice, the number of cases requiring confirmation of labor relations due to the lack of protection of legitimate rights and interests is on the rise, and the dispute over the employment relationship between the sellers and the corresponding platforms is particularly prominent. This reveals that there are still insufficient standards for the identification of labor relations in China. The protection of labor laws is not perfect, and the fairness of cases in judicial practice is difficult to guarantee. Therefore, through the literature review and field research methods, combined with the characteristics of the employment relationship under the O2O model, this paper solves the problem of laborer's rights protection from three aspects: improving legislation, regulating the industry and appropriately relaxing the scope of social security.
