- Abstract
The investigation and oversight of criminal prosecutions in Indonesia, focusing on the case of Firli Bahuri, a former leader of the Corruption Eradication Commission (KPK) who currently faces corruption charges. Employing a normative juridical approach, this research delves into legal provisions and literature to elucidate the grounds for detention and the challenges investigators face. Despite meeting the criteria for detention, Firli Bahuri was not apprehended, raising significant concerns about the reliability of the judicial system and law enforcement practices. A thorough analysis of the legal principles outlined in Articles 20 and 21 of the Code of Criminal Procedure (KUHAP) and relevant scholarly literature is essential. The ambiguity in detention criteria and the influence of external factors highlight the need for more apparent legislative statutes, enhanced training for investigators, and a more robust legal framework to ensure fair and effective law enforcement. By addressing these issues, the criminal justice system can be improved, ensuring equitable and unbiased treatment for all individuals, regardless of social standing or political influence.
