- Abstract
The background of this research is about Article 19 paragraph (2) C of Law Number 5 of 1960 concerning Basic Agrarian Regulations which have not been able to guarantee legal certainty, the article uses a negative publication system, so that the use of the publication system results in giving opportunity for other parties to file a lawsuit against land ownership. This research is a normative legal research using a descriptive method with a qualitative approach. The data sources used in this study are secondary legal sources investigating positive legal norms. The result of this research is that Article 19 paragraph (2) C of Law Number 5 of 1960 concerning Basic Regulations on Agrarian Principles which uses a negative publication system, to meet changing times and the demands of society’s needs must be changed to a positive publication system.
