Abstract

The Collaborative Economy has been understood to be in condition when products, services, and market relationships have changed as sharing startups impact business models. To avoid disruption, companies must adopt the Collaborative Economy Value Chain. In the history of Islam at the early 7 th century, the Islamic state has found a "social security system" which they call as takaful ijtima'i. The Social security in Islam (takaful ijtima'i) is a social obligation (fardhu kifayah), which brings responsibility for muslims, as far they are able, to help each other, and state, as public entity, has a duty to ensure that such responsibility is implemented properly.So, there are two roles which are contained in social security system in Islam, firstly, is state's role as a body of authority who could enforce sharia law and force every person to obey sharia law, and secondly, every muslim's role, including private entity, to help each other who lives in poverty. Inside at-takaful institution contained the spirit to help each other as part of whole society. Then, the spirit to help each other was made become a basic principle in sharia insurance institution (at-takaful al-ijtima'i). In its concept and practice, takaful ijtima'i system, for Indonesia context, could potentially be developed further. How the takaful ijtima'i can be as an alternative insurance system to reconstructing collaborative economy in Indonesia, is the problem that will be elaborated in this paper. Doctrinal approach will be used in discussing the topic of this article.Consideration of the use such methods because the starting point of this research is the analysis of the concepts of the existing Takaful and executed in Indonesia, including the study of the principles and legal norms are universal Islamic insurance and insurance law in Indonesian positive law. Likewise, a study of the accuracy of the model and the use of insurance contract that is used in Indonesia, as well as the correlations needs with the fatwas issued by Ulema Council. In this doctrinal legal research, the data used is secondary data, and secondary data consists of three kinds of material law, namely the primary legal materials, secondary, and tertiary. Some interviews were conducted with several speakers who engaged in the practice of Takaful in Indonesia. In-depth interviewing carried out on Takaful both experts and commissioners and national sharia board of several Islamic insurance company in Indonesia. From interviews with those expected to obtain accurate information about the practice of Islamic insurance in Indonesia. The standard open-ended interviews are used to interview the observer insurance business in Indonesia. Generally, sharia insurance which has been being practiced is still using hybrid contract(multiakad) model, with tabarruakad as main contract, and also in the same time, mudharabahakad(wakalah bil ujroh) as tijariakad.With that hybrid contract model, sharia insurance which has been
